Abstract: | The correct rule of customary law is that the individual right to succeed on intestacy is one conferred by the customary law. The family has a discretion to pass over the person who has a right to succeed, but it can only do so where the reasons therefore are strong and compelling. This is illustrated in the following sections: Testacy under the customary law.
