Problems of intestate succession in Ghana

The correct rule of customary law is that the individual right to succeed on intestacy is one conferred by the customary law. The family has a discretion to pass over the person who has a right to succeed, but it can only do so where the reasons therefore are strong and compelling. This is illustrated in the following sections: Testacy under the customary law. Samansiw – The Marriage of Mohammedans Ordinance (Cap. 129) – Intestacy under the Marriage Ordinance (Cap. 127) – Intestate succession under customary law – The family as successor – The problem of the meaning of the family – The right to succeed. Notes. The article is followed by a comment of Kwamena Bentsi-Enchill ‘Intestate succession revisited’, p. 123-134.
